ARRAIGNMENT THIS FRIDAY IN MINATARE FATALITY ACCIDENT

The driver in a fatal one-vehicle accident Friday night near Minatare has waived his right to a preliminary hearing and been bound over for trial.

21-year-old Drew Schaltz is charged with 2 felony counts: driving intoxicated and manslaughter.

Schmaltz is free on $10,000 bond awaiting his arraignment in Scotts Bluff County District Court this Friday afternoon at 1:00.

21-year old Taylor Magdaleno of Gering was killed when he was ejected from a pickup driven by Schmaltz that rolled multiple times after running off a county road northwest of Minatare shortly before midnight Friday night.

Court documents say an alcohol breath test administered to Schmaltz after the accident showed a blood-alcohol level of .155 nearly twice the legal limit.

Schmaltz was arrested after being treated at Regional West Medical Center in Scottsbluff. The other 4 passengers…two of whom were in the bed of the pickup…were also treated there.

Authorities say none of them was wearing a seat belt.
