LEXINGTON, Neb. (AP) – A Kansas man accused of being drunk and causing a fatal crash will stand trial in Nebraska.

North Platte television station KNOP-TV reports (http://bit.ly/RwA4GL) that 22-year-old Destry Swartz of Coats, Kan., waived his preliminary hearing on Monday, and his case was bound over to Dawson County District Court.

Swartz is charged with motor vehicular homicide, fleeing to avoid arrest and driving while drunk. He is being held on $500,000 bail.

The Nebraska State Patrol says Swartz was speeding away from a state trooper in Lexington on Oct. 9 when he ran a red light and slammed into a pickup driven by 68-year-old Ruben Maravilla-Cortes, of Lexington. Maravilla-Cortes died at the scene.
