DEATH PENALTY PART OF SIDNEY MURDER CASE

Cheyenne County Attorney Paul Schaub says he will seek the death penalty against 53-year old Larry Martinez for the July murder of his ex-girlfriend, 30-year old Mandy Kershman.

Schaub used a suppression hearing yesterday spelled out his intentions with an amended 1st-degree murder complaint, saying he spent 4 months studying the aggravating and mitigating factors in the case before deciding they justified the death penalty.

Citing several of the aggravating factors laid out in state law, Schaub said Martinez used “deliberate and premeditated malice” against Kershman, and was “previously convicted of a crime involving the use or threat of violence to the person, or has a substantial prior history of serious assaultive or terrorizing criminal activity.”

Martinez has an extensive criminal record, dating back to arson and probation violation when he was just 18. He’s been convicted 11 times since moving to Nebraska in 1988…most of them in Cheyenne County…and has served multiple prison terms in both Nebraska and Illinois.

Cheyenne County District Judge Derek Weimer then gave defense attorney Kelly Breen 3 weeks to file a brief in response. After that, Schaub will two week to respond to Breen’s brief, followed by another week for Breen to file his final response.

Martinez is charged with 1st-degree murder and use of a weapon to commit a felony in killing of Kershman after she let him into a Sidney home. Police say Martinez shot Kershman because he was angry over a text message from her.

MORRILL, SHERIDAN COUNTIES VOTE SHOULD NOT AFFECT OUTCOME OF ALLIANCE SCHOOL BOARD RACE.

Northern Morrill and eastern Sheridan Counties residents with property in the Alliance Public Schools district have cast their ballots for the Alliance School board.   However, while Deb Grothen-Wegehoft’s lead has narrowed a bit (to 97 votes) it appears she will hold on to claim a seat on the board.

141 provisional ballots and 9 early ballots (county-wide) will be counted on Thursday.

LOCAL JUDGES RETAINED

12th Judicial District County Court Judge Russ Harford and District Court Judge Derek Weimer have been retained.

Western Nebraska voters overwhelmingly approved retaining the two men on their respective benches.

24,148 people voted to retain Harford, while only 6,224 voted against.

Harford serves as the county court judge in Dawes, Box Butte, Sioux, and Sheridan Counties.

Weimer, who serves from the bench in the southern panhandle based in Sidney, received affirmation from 24,731 voters, while only 6,283 voted against retention.

DAWES, SHERIDAN, & SIOUX CO. ELECTION RESULTS

The vote counting went quickly last night in Dawes, Sioux, and Sheridan counties…with final unofficial totals completed in Sheridan about 8:45, in Dawes about 9:15, and in Sioux about 9:45.

A lack of contested local races helped with no countywide contests races in any of the 3 and none on the city level except in Chadron…where one city council race won’t be decided until the official canvass tomorrow, and maybe not then.

Former councilman Dr John Gamby returns after a 2 year absence with 1,207 votes are 37.65% in a 3-way race, but Paris Fisher leads appointed incumbent Jim Mapes for the other contested seat by just 6 vote…989 to 983.

Dawes County Clerk Cheryl Feist has about 40 provisional ballots that will be decided by the County Canvassing Boards starting tomorrow morning at 10:00, so the totals may change and an automatic recount triggered. Feist doesn’t know how many of the provisional ballots are from Chadron city precincts.

Incumbents Terri Haynes and Keith Drinkwalter retained their seats on the Chadron school board, joined by probation officer Gary Hoffman. Haynes totaled 1,814…Drinkwalter 1,611…and Hoffman 1,391. Andy Spencer finished out of the money with 1,239.

There were also 4 candidates for 3 spots on the Hay Springs school board. Those went to Miriam Kearns with 337, Matt Anderson 335, and Mike Hunzeker with 304 while Jerry Matthews finished 4th with 209.

Six people ran for 3 spots on the Sioux County High School board. Claiming those positions were Shon Whetham 220, James Ellicot 217, and Syndey Meidell 212. Dennis Murphy was a close 4th with 195 while Justin Skavdahl received 155 and Ryan Heckert 112.

The race for the District 1 seat on the Western Nebraska Community College Board went to Kimberly Marcy over Dena Redfern Crews 3,341 to 1,754. Marcy carried her native Sheridan County better than 5-1.

There were two contested seats on the Northwest Rural Public Power District Board. Incumbent Wayne Cobb retained his seat with a 166-143 win over Clint Lefter while Rober Rickenbach defeated Lory Storm 677-486.

The Upper Niobrara White NRD…which has subdistricts but votes district-wide across parts of 4 counties…had one contested race. In it, incumbent John Burke beat James Jelinek in Subdistrict 4 5,100 to 3,351.

Sheridan County voters also approved levy overrides for 3 rural fire districts and one hospital district. The Gordon RFD override passed 243-153, the Rushville Rural 176-124, and the Hay Springs Rural 223-149, while the Gordon Hospital District override enjoyed a 60-40 margin, 604 to 406.

Turnout across Dawes, Sioux, and Sheridan counties was solid, but not great with Sioux and Dawes both around 61%. 19% of the registered voters in Dawes County voted early.

TWO MEN FINALISTS FOR NEW CSC PRESIDENT

The Nebraska State College System on Tuesday announced its two finalists for the presidency of Chadron State College.

They are Dr. Randy Rhine of Chadron, who has served as interim president at Chadron State since May, and Dr. Guy Mills, president of Northwest Kansas Technical College at Goodland.

The two will greet the public in the Sandoz Center on Tuesday, Nov. 13. The first question-and-answer session will be for Mills at 4:30-5:15 p.m. Rhine’s will follow at 5:30-6:15 p.m.

The presidency at Chadron State became vacant with the retirement of Dr. Janie Park on May 11.

SCOTTSBLUFF WOMAN TO COMPETE AT MISS NEBRASKA

21 year old Jessica Littlejohn of Scottsbluff earned her third straight trip to the Miss Nebraska Pageant Saturday when she was crowned Miss Crane Watch Festival in Kearney.

Littlejohn…at Miss Nebraska last year as Scotts Bluff County Fair Queen and this past summer as Miss Chadron…had lost in 3 local pageants since then and says she entered the Miss Crane Watch Festival more for the experience and to make sure it had a large enough field than with any expectations of winning.

As a result, she says winning the crown left her “very excited and very surprised”…describing her feelings as like “butterflies and excitement and bubbles.”

21-year old Kalyssa Hoefer of Friend…another former Miss Nebraska contestant who was Miss Alliance last year…was1st Runner Up to Miss Crane Watch Festival, while 18-year old Kate Lynne Duncan of Morrill, received the Community Service Award.

CSC BENEFACTOR, MADGE FORTUNE-CHICOINE, DIES AT 88

Funeral services will be held Friday for one of the leading benefactors in recent years to Chadron State College, Madge Fortune-Chicoine of Chadron, who passed away Sunday at age 88.

A native of Rushville, Madge was married to Charles Fortune for 27 years before his death in 1980 and to Vern Chicoine from 1997 until his death in 2003.

Many people knew her best from the 25 years she spent as the Activities and Social Services Director at Pioneer Manor in Hay Springs before retiring in the mid-1990s, but left her mark at Chadron State after her marriage to Chicoine…a long-time businessman, rancher, and philanthropist.

Together, they were major contributors to the renovation and expansion of the old college library into the Mari Sandoz High Plains Heritage Center..with the Center’s atrium, a popular site for meetings and recitals, named in their honor.

The couple also donated Chicoine’s home across from both the college and Chadron High School to the Chadron State Foundation as a permanent home for the CSC president.

After Vern’s death, Madge continued to support a variety of Chadron State projects and attend both cultural and sporting events at the school.

Vern Chicoine’s late second wife Frances was the aunt of long-time Chadron State College information director Con Marshall, and were the primary donors to the press box named for Marshall at Elliott Field-Don Beebe Stadium.

Madge was a fixture in the President’s Box there until health problems led her to return in the past year to Pioneer Manor, this time as a resident.

Funeral services for Madge Fortune Chicoine will be Friday morning at 11:00 in the United Methodist Church in Chadron with the Reverend Al Trucano officiating.  A luncheon will follow with burial later in the day at Fairview Cemetery in Rushville.

A memorial has been established for the Madge Fortune-Chicoine Fine Arts Endowed Scholarship at CSC, the Chadron United Methodist Church, or the P.E.O. Cottey College Fund.  Donations may be sent to Chamberlain Chapel, PO Box 970, Chadron, NE  69337.
