Preliminary and Final Plat for Turman Addition

Now is the date, time and place to conduct a public hearing on the application for approval of the Preliminary Plat and Final Plat of Block 1, Turman Addition to the City of Alliance, Box Butte County, Nebraska from Rick Turman, as applicant and Ronald Michael McCarthy, as landowner. The Alliance Planning Commission, at their regular meeting May 28, 2013 recommended approval of the request. Ordinance No. 2724 is before Council on first reading.

G. Ordinance No. 2726 – First Reading

Land Sale to Western Heritage Credit Union

Ordinance No. 2726 is before Council for first reading. This ordinance will authorize the sale of Lots 1 through 11, Block 28, Original Town, City of Alliance, Box Butte County, Nebraska to Western Heritage Credit Union in the amount of $75,000.00. Copies of the Agreement for Sale of Real Estate and a location map have been made a part of the packet for Council’s review.

H. Public Hearing – Ordinance No. 2727 – First Reading

Rezoning Request for Lot 10, Block 6, Simonson Addition

Now is the date, time and place to conduct a public hearing on the Rezoning Request of Templo Nuevo Amanacer to rezone Lot 9 and Lot 10, Block 6, Simonson’s Addition, commonly addressed 1015 Hudson Avenue. The request is to rezone the property to C-3 – Highway Commercial from R-3 – Multi-Family Residential. The Alliance Planning Commission, at their regular meeting May 28, 2013 recommended approval of the request. Ordinance No. 2727 is before Council on first reading.

I. Public Hearing – Ordinance No. 2728 – First Reading

Municipal Code Amendment – Allow Cell Towers in All Zoning Districts

Now is the date, time and place to conduct a public hearing on the request of Viaero Wireless to amend the zoning regulations to allow wireless telecommunications facilities (WCF) in all zoning districts. The Alliance Planning Commission, at their regular meeting May 28, 2013 recommended approval of the request. Ordinance No. 2728 is before Council on first reading.

J. Ordinance Nos. 2729 and 2730

Municipal Code Amendments – Property Maintenance Code

Ordinance No. 2729 is before Council on first reading and will amend the Alliance Municipal Code by establishing a Board of Appeals for the Property Maintenance Code. Ordinance No. 2730 is also before Council on first reading and will amend the Alliance Municipal Code by providing the City of Alliance with more flexibility regarding the collection of condemnation costs with the enforcement of the Property Maintenance Code.

K. Ordinance No. 2731 – First Reading

Municipal Code Amendment – Right-of-Way Encroachments

This ordinance will amend the Alliance Municipal Code and grants the City the authority to require structural upgrades or removal of underground vault space or cavities under public sidewalks at the owner’s expense, if determined to be in the interest of public safety. Ordinance No. 2731 is before Council on first reading.

L. Resolution No. 13-69 – SEAT Project Lease Agreement

Resolution No. 13-69 authorizes the City of Alliance to enter into a Cooperative Agreement with the South Dakota Department of Agriculture Wildland Fire Division. This Agreement designates Alliance as a Single Engine Aircraft Tank (SEAT) base.

M. Resolution No. 13-63 – Conditional Use Permit

Bed & Breakfast at Lots 2-4, Block 7, Box Butte Addition

Now is the date, time and place to conduct a public hearing on the Conditional Use Permit application of Marshall and Starla Endsley for the operation of a bed and breakfast in a R-1 Single Family Residential District. The property is located at 1232 Box Butte Avenue and is described as All of Lots 2 & 3, N 32.06′ of Lot 4, Block 7, Box Butte Addition. The Planning Commission recommended approval of the Conditional Use Permit at their May 28, 2013 meeting. Resolution No. 13-63 is before Council for consideration and will approve the Conditional Use Permit.

N. Resolution No. 13-64 – Streetscape Bid Award

Resolution No. 13-64 will award Schedule A and Schedule B of Phase I of the Streetscape Project to K.L. Wood and Company of Alliance, NE in the amount of $485,741.00.

O. Resolution No. 13-65 – Historic Main Street Request to Fund Raise

This resolution will grant permission to Historic Main Street to raise funds to make improvements and add electronic signage to the kiosk located at 3rdStreet and Box Butte Avenue. As part of their fundraising efforts they are requesting permission to sell, on the City’s behalf, the old street lighting fixtures from Box Butte Avenue when replaced and the Adirondack chairs which were commissioned by the City and now in storage.

P. Resolution No. 13-66 – Library Roof

Resolution No. 13-66 will award the replacement of the Library roof to Wildcat Roofing Co. in the amount of $67,724.00. This recommended award includes an upgrade with the shingles which will be used. The majority of this expense will be covered under the City’s liability insurance policy due to wind damage that was incurred.

Q. Resolution No. 13-67 – Supplemental Preliminary Engineering Services Agreement

Resolution No. 13-67 will approve Supplemental Agreement No. 1 to the Preliminary Engineering Services Agreement with Baker and Associates for the Streetscape Project. This is required to meet the additional National Environmental Policy Act documentation to aid in the production of final construction plans and specifications.

R. Resolution No. 13-68 – NDOR Federal Funds Purchase Program

This resolution will authorize the Mayor to sign the Federal Funds Purchase Program Supplemental Agreement No. 1. The NDOR is replacing the Highway Bridge Program Federal-aid funds which program category had been eliminated.

S. Resolution No. 13-70 – BBDC Tridako Request

Resolution No. 13-70 has been prepared for Council’s consideration and will authorize the Mayor to sign the necessary documents in order to complete the funding to Box Butte Development Corporation for assistance pursuant to the Economic Development Plan, for the purchase of approximately 32 acres of real estate which will then be developed for use by a qualifying business pursuant to the requirements of the Economic Development Plan.

T. Board Vacancies

The City of Alliance is in receipt of several applications from individuals to serve on City Boards.

Mr. Ralph Rhoads would like to serve on the Alliance Planning Commission. Mr. Rhoads lives within the two mile extra-jurisdictional territory zoning district which is eligible for one seat on the Planning Commission. We currently have one vacancy on the Planning Commission which will expire December 31, 2015.The City also received a request from Byron J. Reed to serve on the Temporary Community Garden Board for the 2013 season. Both John S. McGhehey and Richard A. Robb have requested to be reappointed to the Economic Development Plan Application Review Committee. Their current terms are expiring at the end of the month and if re-appointed their new terms would end June 30, 2016.

The City of Alliance continues to have vacancies on the Board of Adjustment, Community Garden Advisory Board, Economic Development Plan Application Review and Citizen Advisory Boards, and Planning Commission. Anyone interested in serving on these Boards should contact the City Clerk’s Office. Information on all of the City Boards is also available on our web site, www.cityofalliance.net.
